Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your access to and use of pesana.net and the Pesana budgeting application (the "Services") provided by Qazana Systems LTD ("Qazana", "we", "us", or "our"). By accessing or using the Services, you agree to be bound by these Terms.

2. Eligibility

You must be at least 18 years old to use the Services. By creating an account, you represent that you meet this requirement.

3. Account Registration

You must provide accurate information when creating an account and keep your credentials secure. You are responsible for all activity that occurs under your account. Report any unauthorised use immediately.

4. Services and Plans

Pesana provides both free and paid subscription plans with features varying by plan. We reserve the right to modify, suspend, or discontinue any part of the Services at any time with reasonable notice. Free accounts may have feature or storage limitations.

5. Payments and Billing

Paid subscriptions are billed in advance on a monthly or annual basis through Paystack Payments Kenya Limited. By subscribing, you authorise Paystack to charge your payment method. A valid payment method is required; failed payments may result in suspended access.

Prices are subject to change. We will provide at least 30 days' notice before any price increase takes effect.

6. Refund Policy

All payments are final and non-refundable. Full details are available in our Refund Policy.

7. Cancellation

You may cancel your subscription at any time via your account settings. Your subscription remains active until the end of the current billing period. No further charges will apply, and your account will revert to the free plan.

9. Intellectual Property

Qazana owns all content, code, design, and trademarks related to the Services. You may not copy, modify, distribute, or reverse-engineer any part of the Services without our prior written consent.

You retain ownership of your data and content. By using the Services, you grant us a limited licence to store, process, and display your content solely to provide the Services to you.

10. Data and Privacy

Your use of the Services is also governed by our Privacy Policy, which describes how we collect and handle personal data under the Kenya Data Protection Act, 2019.

11. Service Availability

We strive to keep the Services available at all times but do not guarantee uninterrupted access. Maintenance and updates may cause temporary unavailability. See our Delivery Policy for details.

12. Limitation of Liability

Qazana Systems LTD shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services. Our total liability is limited to the amounts you have paid us within the preceding 12 months.

13. Indemnification

You agree to indemnify and hold Qazana harmless against any claims, losses, or expenses (including legal fees) arising from your use of the Services or violation of these Terms.

14. Modifications to Terms

We may update these Terms from time to time. Material changes will be indicated by updating the date at the top and notifying you via the website or email. Continued use of the Services after changes constitutes acceptance.

15. Governing Law and Disputes

These Terms are governed by the laws of Kenya. Any disputes shall be resolved in Kenyan courts unless both parties agree to an alternative resolution method.
